Registration and Access to Services

Although many aspects of the Topspin Technologies website are available without having to register or use the Topspin360 device or its affiliated application, some of the content and functionality of the Topspin Technologies website, including the ability to use the Topspin360 device and review the results of the use, require you to register. If you register on the Topspin Technologies website or through the application to use the device or gain access to other content or functionality on the Topspin Technologies website, you will be required to submit information which could be used to personally identify you (“Personally Identifiable Information”). If you register to use the device or its application, you will also be required to provide Topspin Technologies Ltd. with information concerning your health including, but not limited to, your weight, height, current and past treatments and medications, symptoms, and other related medical information (“Personal Medical Information”). In order for the use of the Topspin360 device and other aspects of the Topspin Technologies Ltd. site to be beneficial to you and operate in the manner they were designed to operate, you must provide Personal Medical Information and Personally Identifiable Information that is accurate and complete.

Topspin Technologies Disclosure of your Information

Except as set forth in this Policy or as specifically agreed to by you, TOPSPIN TECHNOLOGIES will not disclose any Personally Identifiable or Personal Medical Information gathered from you on the Topspin Technologies website or through the Topspin application. You agree that TOPSPIN TECHNOLOGIES may release Personally Identifiable or Personal Medical Information: (1) to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order; or (2) in response to a physical threat to you or others, to protect property or defend or assert legal rights. In the event that TOPSPIN TECHNOLOGIES is legally compelled to disclose your Personally Identifiable or Personal Medical Information to a third party, TOPSPIN TECHNOLOGIES will attempt to notify you unless doing so would violate the law or court order.

Topspin Technologies Ltd. may use de-identified data for various purposes including but not limited to research, establishment of normative tables or similar uses.

Topspin Technologies Ability to Change the Policy

TOPSPIN TECHNOLOGIES reserves the right, in its sole and absolute discretion, to amend this Policy from time-to-time. In the event such an amendment constitutes a “material change” (as defined below) in the collection and/or aggregation of Personally Identifiable Information, TOPSPIN TECHNOLOGIES will notify you in advance of such proposed change and will provide you with an ability to “opt-out” of your registration on the Topspin Technologies website. For purposes of this Policy, “material change” means a change which expands Topspin Technologies ability to collect, use or disclose Personally Identifiable Information and/or Personal Medical Information. If, following Topspin Technologies adoption of a material change, you continue to use the Topspin Technologies website or application, such continued use will constitute your acceptance of such material change(s). If you decide that any of the material changes are not acceptable to you then you should immediately stop using the Topspin Technologies website or its application.
